Trans Aid Terms of Service

USER ACKNOWLEDGEMENT AND ACCEPTANCE OF TERMS

Technology Poet, LLC (“Us” or “We”) provides the Trans Aid Program on transgenderheaven.com and www.crossdresserheaven.com website, application(s) (including mobile applications), and various related services (collectively, the “Program”) to you, the user, subject to your compliance with all the terms, conditions, and notices contained or referenced herein (the “Terms of Service”), as well as any other written agreement between us and you. In addition, when using particular services or materials on transgenderheaven.com or www.crossdresserheaven.com, users shall be subject to any posted rules applicable to such Services or materials that may contain terms and conditions in addition to those in these Terms of Service. All such guidelines or rules are hereby incorporated by reference into these Terms of Service.

YOUR USE OF THIS SITE CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT WISH TO BE BOUND BY THE THESE TERMS OF SERVICE, PLEASE REFRAIN FROM PARTICIPATING IN THE TRANS AID PROGRAM. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE TRANS AID PROGRAM, OR ANY PRODUCTS, SERVICES, CONTENT, OR OTHER INFORMATION AVAILABLE ON OR THROUGH THE PROGRAM, IS TO STOP USING THE TRANS AID PROGRAM PRODUCTS OR SERVICES. YOUR AGREEMENT WITH US REGARDING COMPLIANCE WITH THESE TERMS OF SERVICE BECOMES EFFECTIVE IMMEDIATELY UPON COMMENCEMENT OF YOUR USE OF THE PROGRAM.

By using the Trans Aid Program, applying, receiving a contribution and/or donating, you engage in our “Service” or “Services” and agree to be bound by these Terms of Services, including those additional terms and conditions and policies referenced herein and/or available by hyperlink (site wide terms of service). These Terms of Service apply  to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

These Terms of Service are effective as of the “Last Modified” date identified at the top of this page. We expressly reserve the right to change these Terms of Service from time to time without notice to you. You acknowledge and agree that it is your responsibility to review this Program and these Terms of Service from time to time and to familiarize yourself with any modifications. Your continued use of this Program after such modifications will constitute acknowledgement of the modified Terms of Service and agreement to abide and be bound by the modified Terms of Service. However, for any material modifications to the Terms of Service or in the event that such modifications materially alter your rights or obligations hereunder, such amended Terms of Service will automatically be effective upon the earlier of (i) your continued use of this Program with actual knowledge of such modifications, or (ii) 30 days from publication of such modified Terms of Service on this Program. Notwithstanding the foregoing, the resolution of any dispute that arises between you and us will be governed by the Terms of Service in effect at the time such dispute arose. As used in these Terms of Service, references to our “affiliates” include our owners, subsidiaries, affiliated companies, officers, directors, suppliers, partners, sponsors and advertisers, and includes (without limitation) all parties involved in creating, producing, and/or delivering this Program and/or its Services.

GENERAL CONDITIONS

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms of Service will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.  More information can be found in our Privacy Policy, which can be found at https://transgenderheaven.com/privacy  You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.  The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms of Service.

ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this Program is not accurate, complete or current. The material on this Program is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this Program is at your own risk.

This Program may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this Program at any time, but we have no obligation to update any information on our Program. You agree that it is your responsibility to monitor changes to our Program.

TRANS AID PROGRAM OFFICIAL RULES

By submitting an application, donating or participating in any way with the Trans Aid program you fully and unconditionally agree to and accept these Official Rules.

Eligibility. Must be at least 18 years old to enter and a member in good standing on Transgender Heaven for at least 6 months. Employees, officers, or directors of Sponsor, its parent companies, affiliates, subsidiaries, and their children, parents, spouse, and members of their household are ineligible to participate. No purchase or online entry necessary. A purchase does not enhance your chance of being selected.

Effective date of application. Applications made online will be effective on the day received. All entries become the exclusive property of Technology Poet, LLC and will not be acknowledged or returned. You are responsible for your costs of applying, including online access charges, long distance telephone charges, and postage.

Selection of recipients. Recipients will be determined by the Program Administrators. The following will be considered when selecting a recipient: The authenticity of the request, need of the applicant, ability to make a positive impact on the applicant, length of membership and activity on Transgender Heaven. Recipients must agree to the use of their names, voices, and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law.

Notification of recipients. Program recipients will be notified by email.  An email will be sent to the recipient within one week after the monthly selection. All decisions are final and binding. Should the email be returned to the Sponsor as invalid, two more attempts will be made via email. Recipients must contact the Sponsor within 5 calendar days from the date the notification is sent by Sponsor to claim their contribution. Failure to contact Sponsor within that 5 day period will result in immediate disqualification of the selected participant and a new recipient will be selected. No exceptions will be made to this rule. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify recipients.

In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email account.

Other conditions. Sponsor, its agents and representatives, its parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and legal advisors are not responsible for and will not be liable for (I) late, lost, damaged, misdirected, incomplete, unintelligible or postage due applications; (II) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind; (III) failed, incomplete, garbled or delayed computer transmissions; (IV) any condition caused by events beyond the control of Sponsor that may cause Program to be disrupted or corrupted; (V) any injuries losses or damages of any kind arising in connection with or as a result of the Program, or from participation in the Program; or (VI) any printing or typographical error in any material associated with the Program.

Indemnification. You agree to release and hold Sponsor, its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Program, including without limitation, personal injury, death and property damage, and claims based on publicity rights, defamation or invasion of privacy. 

Choice of law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with this Program, will be governed by, and construed in accordance with, the substantive laws of California, United States of America..
